CS/CS/HB 253: Offenses Involving Motor Vehicles​

GENERAL BILL by Judiciary Committee ; Criminal Justice Subcommittee ; Bankson ; (CO-INTRODUCERS) López, J.

Offenses Involving Motor Vehicles; Reclassifies offense of driving, moving, or causing to be moved vehicle or equipment with certain lighting on highway as third degree felony in specified circumstance; increases the penalty for knowingly altering a motor vehicle registration certificate, a license plate, a temporary license plate, a mobile home sticker, or a validation sticker or obscuring a license plate from a noncriminal traffic infraction to a second degree misdemeanor; provides criminal penalties if person purchases, possesses, manufactures, sells, offers to sell, or otherwise distributes license plate obscuring device; provides enhanced penalty if person uses license plate obscuring device for specified purposes.

License plate frames are already illegal in many states. Any frame that covers the state name on the plate, or registration tabs, is illegal. It's also illegal to have the clear or tinted license plate covers. These block the reflectivity of the plate causing toll road license plate readers to mess up and they also block the police from seeing the plate at night.

Now, let's see if the owner of a vehicle gets ticketed for having the plate frame on their new car with the ping Autonation frame the dealer installed. Or the dealer advertising plate frame they install when you transfer your plate from the old car to the new car at the time you trade in your old car.

Again, lawyers that aren't involved in the industry only hear certain things, so they make laws about it. I think Bankson is probably addressing the plate covers that block red light and speed cameras from capturing an image of your plate. Because they don't what else is out there, this law now impacts innocent things that have been allowed for years.
