It’s not that uncommon. 32-33hz is the sweet spot for most builds. One of the ones I did years ago was a single BTL 12 tuned to 28hz on a zx2500..... that thing was fun.
You guys are discounting the fact it is highly unlikely this even gets to a judge. At a <$500 repair, and lawyers charging $300-$500 an hour, why would they even bother to fight this? They would fix it and be done with it.
This isn't true. Even to have a lawyer review this case, would cost more money then for them to fix it.... unless they are complete morons, or stubborn, much easier to just settle.
Several years on the forums, with many threads discussing this, (which also can be found by searching with right keywords) provides the evidence to make the reasonable assumption. See my post above.

I didn't read the entire thread but it sounds like you have two issues, one being regenerative braking and the other the ride.
I forgot about the regen braking almost right away, not sure if I even noticed it between my '19 and '20 to be honest. To be fair my wife drives a Tesla, which is one...
